กรณีการหายไปของนายมะยาเต็ง มะรานอ ภารโรงลูกจ้างประจำของสำนักงานเขตพื้นที่การศึกษายะลาเขต 2 ขอให้ศาลสั่งเป็นบุคคลสาบสูญ เพื่อให้ครอบครัวได้รับสิทธิประโยชน์ตามกฎหมาย
ในวันศุกร์ที่ 25 กันยายน พ.ศ. 2552 เวลา 9.00 น. ศาลจังหวัดยะลามีนัดไต่สวนคำร้องของนางซูมาอีเด๊าะ มะรานอ ภรรยาขอให้ศาลสั่งว่านายมะยาเต็ง มะระนอ สามีเป็นบุคคลสาบสูญตามมาตรา 61 วรรค 2 ประมวลกฎหมายแพ่งและพาณิชย์ โดยใช้เงื่อนเวลาสองปี เพราะเป็นการหายตัวไปในระหว่างสถานการณ์ฉุกเฉินที่อาจมีอันตรายถึงแก่ชีวิต โดยศาลได้มีหมายเรียกพยานสำคัญสองปากคือ แม่ทัพภาคที่ 4 พลโท พิเชษฐ์ วิสัยจร และ ผศ.ดร. ศรีสมภพ จิตร์ภิรมย์ศรี คณะรัฐศาสตร์ มหาวิทยาลัยสงขลานครินทร์ วิทยาเขตปัตตานี มาเป็นพยานฝ่ายผู้ร้อง หากศาลจังหวัดยะลามีคำสั่งว่านายมะยาเต็งเป็นบุคคลสาบสูญแล้ว จะมีผลทำให้ครอบครัวของนายมะยาเต็งได้สิทธิจากเงินเดือนส่วนที่ถูกต้นสังกัดระงับจ่าย และได้บำเน็จและสวัสดิการที่สมควรจะได้รับจากต้นสังกัดของนายมะยาเต็ง อันเป็นการเยียวยาความเสียหายเบื้องต้นให้แก่ครอบครัว สำหรับประเทศไทยนั้นยังไม่มีความผิดฐานบังคับให้บุคคลหายไปทำให้ผู้เสียหายยังไม่สามารถฟ้องร้องทางแพ่งหรืออาญาต่อการละเมิดสิทธิมนุษยชนขั้นรุนแรงอย่างกรณีการบังคับให้หายไปได้
